Welcome to S. Sexton Design Associates. These Terms of Service ("Terms") govern your access to and use of the website located at www.sextondesignassociates.com (the "Site") and the interior design services provided by S. Sexton Design Associates ("the Company," "we," "us," or "our").

By accessing our Site or engaging our services, you ("the Client," "User," or "you") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

1. Scope of Services

S. Sexton Design Associates specializes in residential kitchen and bath remodeling within Monmouth, Middlesex, and Ocean County, New Jersey. Our services include, but are not limited to:

• Confident Kitchen Guide: A digital roadmap provided for informational purposes to guide homeowners through renovation decisions.

• Signature Design Services: A two-hour in-home consultation for expert advice, plan review, or design sample discussion.

• Design & Field Measure Service: Site-specific measurements, creation of scaled floor plans, and refinement of AI-generated concepts.

• Advisory Support: Professional guidance for a specified duration (typically 13-20 hours) covering plan reviews, procurement assistance, and contractor communication.

• Signature Experience: Comprehensive, full-service project management from initial design to final completion.

2. Professional Relationship and Disclaimers

2.1 Design vs. Contracting: S. Sexton Design Associates is an interior design firm. We provide design, aesthetic, and advisory services. We are not licensed general contractors, architects, or structural engineers. All construction, electrical, plumbing, and structural work must be performed by licensed professionals hired directly by the Client.

2.2 Contractor Responsibility: While we may provide "Signature Experience" project management or "Advisory Support" regarding contractor communication, the Company is not responsible for the performance, workmanship, or contractual obligations of third-party contractors or vendors. Any disputes regarding construction quality or timelines must be resolved between the Client and the respective contractor.

2.3 AI-Generated Concepts: For services involving AI-generated concepts, the Client acknowledges that these are for conceptual inspiration only. Final designs and field measures provided by the Company will supersede any AI-generated content to ensure technical accuracy and safety.

3. Client Responsibilities

The Client agrees to:

• Provide accurate information regarding project goals, budget, and requirements.

• Ensure the Company has safe and reasonable access to the project site for measurements and consultations.

• Secure all necessary permits and approvals required by local New Jersey municipalities, unless explicitly agreed otherwise in a separate written contract.

• Verify all dimensions with the contractor performing the work prior to ordering materials (e.g., cabinetry, flooring, appliances), even where the Company provides field measurements.

4. Fees and Payment Terms

• Service Fees: Fees for services are outlined in specific project proposals or service descriptions.

• Digital Products: Payments for the "Confident Kitchen Guide" or other digital downloads are due in full at the time of purchase. Due to the nature of digital downloads, all sales of digital guides are final and non-refundable once the file has been accessed or downloaded.

• Consultations: Fees for "Signature Design Services" and other consultation services are generally non-refundable once the service has been scheduled or performed. Cancellation policies apply as stated during booking.

• Retainers: For Advisory Support and Signature Experience services, a non-refundable retainer may be required before work commences.

5. Intellectual Property

All drawings, scaled floor plans, mood boards, and design documents created by S. Sexton Design Associates remain the intellectual property of the Company. The Client is granted a limited, non-exclusive license to use these materials solely for the completion of the specific project for which they were created. These materials may not be sold, distributed, or used for other projects without express written consent.

6. Limitation of Liability

S. Sexton Design Associates provides conceptual design services. We are not licensed architects, structural engineers, or general contractors. All design concepts and plans must be reviewed and verified by a licensed contractor or engineer prior to construction. We are not liable for any structural issues, construction errors, or damages resulting from the use of our conceptual designs.

To the maximum extent permitted by law, S. Sexton Design Associates shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our Site, digital guides, or design services. Our total liability for any claim arising out of these Terms or our services shall not exceed the total amount paid by the Client to the Company for the specific service in question.

7. Termination

Either party may terminate the professional relationship with written notice. In the event of termination, the Client shall be responsible for payment for all hours worked and services rendered up to the date of termination.

8. Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the courts located in Monmouth County, New Jersey.

9. Changes to Terms

S. Sexton Design Associates reserves the right to modify these Terms at any time. Updated terms will be posted on our Site with a revised "Last Updated" date. Continued use of the Site or services after such changes constitutes acceptance of the new Terms.
